1. PARTIES, CONSENT AND DECLARATION
This Terms of Use and Membership Agreement (“Agreement”) is entered into electronically between the user (“User”) who uses the Catcha mobile application, website, and associated digital services (“Platform” or “Application”) and the Platform management/developer, which owns all intellectual and commercial rights of the Platform.
By downloading the application to their device, creating an account, checking the “I Accept” option, or continuing to use the Platform services, the User declares that they have read, understood, and accepted all the provisions of this agreement.
The User acknowledges that the consent given electronically constitutes a legally binding written contract under the Turkish Obligations Code No. 6098 and applicable international electronic commerce laws.
The Platform reserves the right to unilaterally update the features, algorithms, interface, access model, or scope of service of the application for legal requirements, security needs, operational requirements, technical infrastructure changes, or to improve the user experience.
Catcha is a digital social network platform that offers social discovery, user matching, community interaction, event organization, and augmented reality (AR) experiences.
2. DEFINITIONS AND NATURE OF SERVICE (HOST PROVIDER AND MODERATION LIMITS)
Catcha is a user-based digital platform that enables users to create profiles, match with each other, organize events, participate in events, and access location-based augmented reality experiences.
Host Provider Status: The Platform operates as a “Host Provider” under relevant internet regulations (including Law No. 5651). The Platform is under no obligation to pre-screen, continuously monitor, or guarantee the legality of user-generated content, including profile contents, direct messages, event descriptions, media uploads, and general user behaviors.
Moderation and Algorithmic Systems: The Platform may utilize AI-powered moderation systems, spam filters, security analyses, user reporting mechanisms, age verification systems, and algorithmic matching or recommendation systems. However, the use of these systems does not imply that the users' true identities are definitively verified, contents are guaranteed to be lawful, events are guaranteed to be safe, or user behaviors are continuously controlled.
While the Platform implements reasonable technical and administrative measures for user safety, it does not permanently and actively guarantee the full compliance of user-generated content or behavior with the law. The Platform's moderation activities cannot be interpreted as creating an editorial control or pre-audit obligation in a legal sense.
3. COMPREHENSIVE AGE VERIFICATION AND CHILD SAFETY POLICY
Age and Legal Capacity: Catcha can only be used by individuals who are at least 18 years old. The User declares and warrants that they are at least 18 years of age, have full legal capacity to enter into binding agreements, and that all information provided is accurate.
Verification Policy: In order to ensure child safety, prevent fraudulent accounts, reduce fraud risks, and protect community security, the Platform reserves the right to request selfie verification, liveness checks, phone verification, or official ID verification from the User. Verification processes are conducted strictly for security purposes.
Child Safety and CSAM Policy: Child sexual abuse, child sexual exploitation, grooming activities, unlawful behavior targeting children, or CSAM (Child Sexual Abuse Material) contents are strictly prohibited. The Platform reserves the right to remove such content immediately, suspend relevant accounts, block device access, and report incidents to law enforcement authorities.
Account Suspension and Permanent Deletion: If a reasonable doubt arises regarding age verification, the account may be temporarily suspended. Accounts of users found to be under the age of 18 will be terminated permanently and immediately. Data outside of legal retention obligations may be deleted or anonymized within the scope of data protection legislation and child safety standards.
4. USER-GENERATED EVENTS (UGC POLICY)
The content, safety, legality, organization, attendee management, and required official permissions of any events created through the Platform belong entirely to the user who created the event. Obtaining necessary official permits for events organized in public spaces is solely the responsibility of the event organizer.
The Platform is not an organizer, tour provider, insurance provider, security company, or travel agency. The Platform does not guarantee that the events will take place, will be safe, will possess the declared characteristics, or that the statements of users are true. Physical meetings between users are entirely at the users' own risk and responsibility.
5. AR (AUGMENTED REALITY) AND REAL-WORLD SAFETY
Navigation Disclaimer: Catcha is not a navigation, traffic routing, or professional mapping system. AR objects and event locations are provided solely for digital entertainment and experience purposes. The Platform does not guarantee that digital objects will correspond exactly with actual physical locations in the real world.
Physical Safety: The User agrees to use the AR feature carefully, maintain environmental awareness, and pay attention to their physical safety. All risks associated with falls, collisions, traffic accidents, loss of attention, or physical injuries that may occur during the use of AR belong to the User. Active use of AR features is strongly discouraged while driving vehicles, motorcycles, scooters, or similar transportation devices.
Prohibited Physical Areas: The User agrees not to trespass on private properties, military zones, construction sites, high-risk areas, railways, or high-voltage zones. All administrative, criminal, and legal responsibilities arising from such violations belong entirely to the User.
6. LOCATION SECURITY AND MANIPULATION LIMITATIONS
The Platform does not directly display the exact GPS coordinates of users to other users. Distance information may be shown as approximated, rounded, delayed, or algorithmically masked. Real-time point-to-point live location sharing is not provided.
Location Manipulation: The following activities are strictly prohibited: Use of Fake GPS, VPN-based location manipulation, device spoofing, mock location software, or algorithm manipulation. If such activities are detected, the Platform reserves the right to suspend or permanently terminate the accounts.
7. HARASSMENT, SECURITY BREACHES, AND COOPERATION WITH AUTHORITIES
The Platform may remove relevant content, suspend accounts, or block access in the event of serious security risks such as harassment, threats, blackmail, stalking, fraud, human trafficking, sexual assault, physical violence, and child safety violations. The Platform shares data with official authorities only within the scope of formal and legally valid requests submitted in compliance with applicable legislation.
8. PROHIBITED ACTIVITIES AND REPEAT VIOLATOR POLICY
The following activities are strictly prohibited: Gambling organization, drug trafficking, unauthorized weapon sales, escort/prostitution services, deepfake pornography, obscene content, child abuse material, hate speech, racism, terrorist propaganda, doxxing, revenge porn, harassment campaigns, use of fake accounts, impersonation, fraud, malware distribution, spamming activities, and unauthorized sharing of other users' personal data.
In case of repeated violations, the Platform may permanently close the account, block device access, and technically restrict the creation of new accounts.
9. MESSAGING AND LIMITED REVIEW AUTHORITY
The Platform does not routinely monitor user messages actively in real-time. However, limited security reviews may be conducted in case of user complaints, security breaches, suspicion of fraud, child safety risks, or formal requests from official authorities. Such reviews are conducted only to the extent necessary, proportional to the purpose, and by authorized personnel.
10. CONSUMER LAW AND LIMITATION OF LIABILITY
The Platform does not guarantee uninterrupted service, absolute security, continuous availability, or error-free operation. Except in cases of intent or gross negligence, the Platform cannot be held liable for data loss, loss of profits, loss of reputation, indirect damages, or disputes between users.
The total financial liability of the Platform shall not exceed the total amount paid by the user to the Platform within the last 12 months. Nothing in this agreement shall eliminate user rights that cannot be limited under applicable consumer protection legislation.
11. GOVERNING LAW AND JURISDICTION
In case of disputes arising from this agreement, the Courts and Enforcement Offices of Istanbul shall have jurisdiction. For users acting as consumers, Consumer Arbitration Committees and Consumer Courts may be authorized within the scope of applicable legislation.
