1. GENERAL PRINCIPLE AND PLATFORM ROLE
Catcha adopts the fundamental principle of respecting the intellectual property rights of its users' generated content (including profile images, event content, descriptions, media files, and all similar user-generated content). The platform operates as a 'hosting provider' under Law No. 5651 and is under no obligation to pre-screen user content automatically. Instead, a 'notice and takedown' mechanism is applied against copyright infringements.
2. COPYRIGHT INFRINGEMENT NOTICE
If a content owner or their authorized representative believes that content on Catcha infringes their copyright, a formal notice must be submitted including the following information:
- Name, surname, or legal title of the right holder
- Contact information (email and phone, if available)
- Description of the work claimed to have been infringed
- The exact location or link of the content on the platform (URL/relevant screen details)
- A good faith statement by the notifying person that this use is not authorized by the right holder.
3. EXAMINATION AND TAKEDOWN PROCESS
Once a valid notice containing the above requirements reaches the platform administration, the relevant content will be temporarily disabled or removed as soon as possible (within a reasonable technical review period). During this process, the user who uploaded the content is also notified of the situation and granted the right to appeal.
4. COUNTER-NOTICE AND REINSTATEMENT OF CONTENT
If the user whose content was removed believes that the copyright infringement claims are unfair or erroneous, they can submit a counter-notice to the platform. The counter-notice must include:
- Identity and contact information of the user,
- Details of the removed content,
- A statement that the content was removed as a result of a mistake or misidentification.
When a valid counter-notice is received, the platform forwards this notice to the original claimant. Unless the right holder officially documents that they have initiated legal proceedings, the content may be restored to access at the platform's discretion.
5. REPEAT INFRINGER POLICY
Catcha reserves the right to suspend, restrict, or completely close the accounts of users who repeatedly infringe intellectual property rights. This policy is strictly enforced to protect the general safety and legal compliance of the platform.
6. CONSEQUENCES OF BAD FAITH NOTIFICATIONS
Persons who intentionally submit false or misleading infringement notices for the purpose of removing content on the platform without any material or legal basis are legally liable for all direct or indirect damages that may arise from such actions.
7. CORE PRINCIPLES OF THE POLICY
Catcha adopts international standards and local legislation in the field of copyright and intellectual property as a balancing element. In this context: Transparent notification mechanism, right of counter-notice, impartial review process, and content removal and restoration balance principles are applied.
8. LIMITATION OF LIABILITY
Catcha cannot be held liable for copyright infringements arising from user-uploaded content that has not been legally reported to it in accordance with legal regulations. The platform only acts upon valid, concrete, and verifiable notifications.
10. FINAL PROVISION
This Copyright and Content Takedown Policy is prepared to ensure that the Catcha platform is operated safely, fairly, and legally. The platform reserves the right to make reasonable changes to this policy in line with technological developments, legislative changes, or platform needs. Updates made become effective from the date they are published on the platform, and the continued use of the service by users means acceptance of the updated terms. This policy is not a standalone contract; it forms a holistic legal framework together with the Terms of Use and Privacy Policy. If any provision becomes invalid or unenforceable, the remaining provisions shall continue to be valid.
